Terms and conditions

  1. All Guests of the Blue Diamond Hotel are obliged to produce a document with a photograph at the reception desk while checking in to confirm their identity. In case the Guest refuses to show the document the Receptionist has the right to refuse to issue a card/room key.
  2. In the registration form, the Guest signs the check-in form with his/her name and surname. At the Guest's request, the receptionist is obliged to enter the other data from the identity card.
  3. A room in the hotel is let for the day which starts at 3 p.m. and ends at 12 p.m. the next day.
  4. If the Guest does not specify the length of the stay when booking a room, it is assumed that the room is rented for one day.
  5. Should the Guest wish to prolong the stay for a period exceeding the time indicated on the day of arrival, they should report it at the reception desk before 10:00 a.m. the day on it expires. An extra charge of 50 PLN is charged for each commenced hour of stay.
  6. Staying in the room or leaving things after 12: 00 pm without reporting it at the reception desk is treated as an extended stay.
  7. The hotel guest is not allowed to share the room with other people, regardless of the fact that the time for which they have paid for has not yet passed.
  8. Individuals who are not checked in at the hotel are only allowed to stay as guests in the hotel room from 7:00 a.m. to 10:00 p.m.
  9. The Guest's stay in the room after 10:00 p.m. is considered a consent of the accommodation provider to pay for the extra accommodation in the room according to the prices charged on the day of accommodation.
  10. The reception desk issues a card/key on the basis of the check-in form.
  11. When leaving the room the Guest should check if the door is locked and leave the card/key at the front desk.
  12. Children under 12 years of age must be supervised by adults at all times during their stay in the hotel. Children's guardians are responsible for their conduct, including any damage to the property and/or loss caused by them.
  13. It is forbidden to bring animals to the hotel, with the exception of guide dogs for the visually impaired.
  14. The hotel provides services in according to the hotel's quality and standard. Should there be any concerns about the quality of services, the Guest is requested to report them immediately at the reception desk, which will enable the hotel staff to take a prompt action.
  15. The liability of the Hotel for the loss or damage to property belonging to the Guest is regulated by Articles 846-849 of the Civil Code. The liability is limited unless the belongings are deposited at the reception desk. The Hotel has the right to refuse to accept for safekeeping of money, papers and valuable objects, especially jewellery and articles of scientific or artistic value if they pose a threat to the hotel's security or are valuable in relation to the size or standards of the hotel or take up too much space.
  16. Hotel guests are required to maintain quiet hours from 10:00 p.m. to 6:00 a.m. next day.
  17. The conduct of Guests and visitors to the hotel should not disturb the other guests. The Hotel is entitled to refuse further services to a person who violates that rule.
  18. The Guest of the Hotel is fully liable for any damage or impairment of the Hotel's equipment and appliances due to their fault or the fault of their visitors.
  19. The Hotel Guest is obliged to report any damage to the front desk as soon as it is discovered.
  20. Due to the fire safety, it is forbidden to use heaters, irons and other electric appliances not included in the room equipment in the hotel rooms and in other premises. The above does not apply to battery chargers and power supplies for TVs and computers.
  21. In accordance with the Act of 8 April 2010 amending the Act on Health Protection against the Effects of Tobacco Use and Tobacco Products and the Act on the State Sanitary Inspection (Journal of Laws No. 81, item 529) - there is an absolute ban on smoking cigarettes and tobacco products on the premises of the entire hotel.
  22. Breach of the ban on smoking cigarettes and tobacco products is treated as equivalent to a consent to cover the costs of de-merchandising the room in the amount of PLN 900.00, which means that the costs will be added automatically to the hotel bill.
  23. Personal belongings left by the Guest on departure will be sent at the expense of the Guest to the address indicated by them.
  24. If no such disposition is given, the hotel will store the belongings for 3 months and then donate them to a charity or to the use of the hotel's guests.
  25. The hotel reserves the right to request a credit card pre-authorization or to request advance payment "upfront" for the first night of the stay, in regards to Guests staying at the hotel for the first time.
  26. Upon refusal, the receptionist has the right to deny the card/room key.
  27. The receptionist has the right to ask the Hotel Guest to pay the bill before checking out, if the bill exceeds the amount of PLN 1,000.00.
  28. The Hotel has a guarded, monitored car park, payable PLN 20.00 per day (the number of spaces is limited) and has free of charge, unguarded spaces.
  29. Violation of the terms stated herein may result in the hotel refusing to provide further services to the person breaching them. As a consequence, the violator is obliged to comply with the requirements of the hotel staff, pay for the services rendered so far and pay for any damage caused, as well as leave the hotel premises.
  30. The Hotel has the right to refuse to accommodate a Guest who is under the influence of alcohol or drugs, as well as a Guest who, during the previous stay, violated the regulations causing damage to the hotel property or the Guests', or harmed the Guests, hotel staff or other persons staying at the hotel, or otherwise disturbed the peace of the hotel.


Terms and conditions of the Relaxation Zone at Blue Diamond Hotel

GENERAL INFORMATION



  1. These rules and regulations outline the principles of using the services provided by the Blue Diamond Hotel's Active SPA and, more specifically, the Relaxation Zone in the facility located at Nowa Wieś 414, 36-001 Trzebownisko.
  2. The following terms are used in the Rules and Regulations:
  3. Facility Management - persons who manage a particular section and on days specified the hotel on behalf of its administrator K&B Development Barczak, Kloc Spółka Komandytowa respectively.
  4. Policy - the content of this document as well as other documents, approved by the Management of the facility, regulating the principles concerning all services provided by the Blue Diamond Hotel's Active SPA, more precisely the Relaxation Zone.
  5. Service User/Guest - an individual who uses the services of the Blue Diamond Hotel.
  6. Rules and Regulations primarily define:
  7. -the manner and form in which services are provided by the hotel, with due regard to the availability and quality of such services,
  8. -the conditions under which the hotel provides its services to its guests, including the responsibilities of the hotel's staff as well as the conditions of cooperation between the staff and the guests of the facility so as to ensure proper functioning, safety and comfort of its guests,
  9. -legal rights and obligations for the guests of the Blue Diamond Hotel who use the Relaxation Zone.
  10. Before entering the Relaxation Zone and using particular equipment/services, purchasing services online or booking a service, one must read the Terms and Conditions.
  11. The Rules and Conditions of the Relaxation Zone apply to all its users. By purchasing, being given a free of charge access ticket/pass or having any other admission pass, it is assumed that each guest accepts the regulations of the Terms and Conditions along with any other regulations regarding the safety on the facility's premises.
  12. The Relaxation Zone is a CCTV monitored facility in order to improve the safety of persons on its premises. Not only do Guests agree to monitoring of their stay in the facility, but also to the usage of the footage obtained in this way in case any disputes arise, e.g. concerning settling payments for the services, purchasing food and beverages and/or non-compliance with the Rules and Regulations, etc.


RULES OF RELAXATION ZONE OF THE BLUE DIAMOND ACTIVE SPA HOTEL


  1. The Relaxation Zone is open daily from Monday to Sunday from 11.00 a.m. to 11.00 p.m. The management reserves the right to change the opening hours and to completely close the facility on specified days.
  2. The Relaxation Zone is divided into main areas accessible to Guests. They are: the Pool area, the Sauna area, the Gym and the Spa. Each of these zones has a different function and entry to these zones is subject to different fees, as specified in the Facility's price list.
  3. More detailed rules applicable to each of the zones listed above in paragraph 2, as well as to equipment and attractions, are specified in separate Rules and Regulations and/or manuals, the content of which is supplementary to these Rules and Regulations, available at the Reception of the Blue Diamond Active SPA Hotel.
  4. The Hotel is not responsible for any actions, damages or consequences thereof resulting from a breach of these terms and conditions by Guests of the facility.
  5. Guests are prohibited from distributing leaflets, selling goods, offering and providing services on the premises without the written consent of the facility management.
  6. It is forbidden to bring food, alcohol or other beverages into the Relaxation Zone.
  7. Recreation Area guests are obliged to use the facilities and take care of the equipment and plants on the premises. Should the objects/equipment of the facilities be misused, negligently soiled, damaged or removed from its original place, the user of the recreation area is fully legally and financially responsible for the resulting damage.
  8. It is mandatory to use the cloakroom (changing rooms) and lockers at the facility. Due to CCTV monitoring of the changing rooms, it is necessary to change in the cabins designated for this purpose.
  9. The management is authorised to refuse services provided by the hotel to guests who violate the rules and conditions. Should the above-mentioned conditions be violated, the hotel staff will be entitled to summon the relevant services. Admission fees are not refundable in such cases.
  10. The facility management or persons authorised by them may not allow a person to enter the Relaxation Zone or may require that person to leave the facility if the person's conduct clearly indicates that the person is intoxicated or under the influence of an illegal substance and/or not abiding to the rules and regulations of the facility.
  11. If an emergency arises, the management of the facility has the right to restrict access to the Relaxation Zone completely or partially, especially if the maximum number of permitted users in the facility is exceeded, or in the case of an urgent emergency, or in the event of other unforeseen circumstances that threaten the guests' health or safety.
  12. Visitors to the Relaxation Zonemust strictly follow the instructions displayed on signs. It is forbidden to damage, stain or remove them from their original place.
  13. Please note that the attractions and equipment available in the facility are controlled automatically. The hotel does not guarantee full access to all attractions and facilities on the premises at all times, especially due to repairs and maintenance.
  14. Updated information on services and products offered by Hotel Blue Diamond Active SPA is available in leaflets and pricelists available on the premises of the facility, as well as on the website, at the Front Desk and in the SPA Reception area.


TERMS OF USE OF THE RELAXATION ZONE


  1. In order to use our Relaxation Zone, the Guest must have a valid pass. It is a cashier-activated transponder purchased for the amount equivalent to the service purchased. The transponder must be worn on the wrist and presented when required by the hotel staff.
  2. One user can purchase the number of transponders corresponding to the number of persons present at the time of purchase.
  3. Any admission passes and fees, which have been already paid for, are non-refundable, unless the Hotel is to blame for the failing to perform the service. The Hotel has the right to deny the exchange of purchased services for other products or services.
  4. Residing in and around the changing rooms is only permitted for the purpose of changing clothes. There is a requirement on the guest of the Relaxation Zone to ensure that the locker is properly and firmly locked with the transponder and that the transponder is properly stored. In the event of the loss of it, the contents of the locker will only be handed over to the guest after the inspection and after the guest has provided evidence of ownership of the items left behind. In such circumstances, the hotel staff are also entitled to identify the guest and take contact details. This data will be permanently deleted and will not be stored once the day ends and all guests have left the hotel. The Hotel is not responsible for any valuables left e.g. in the lockers.
  5. Should a guest leave the Relaxation Zone and, upon final settling the account at the cash desk, question the purchase of goods or services, claiming that they have not been purchased or used, the evidence is produced (on the basis of operations recorded in the system). In the event of a dispute over the purchase of goods or services, the guest has the right to lodge a complaint to the manager on duty. A Guest who questions the purchase of services or their execution may lodge a complaint within 7 days from the date of the claimed service. The complaint will be reviewed by the Hotel within 14 days of the complaint's submission.
  6. The Relaxation Zone, including the outdoors, must be used no later than 11.00 p.m., taking into account the time for changing and settling payment for additional services at the SPA Reception.
  7. Persons whose skin indicates infectious diseases and conditions, i.e. candidiasis, eczema, rubella, etc., or persons suffering from cardiovascular or respiratory diseases ( varicose veins, ischaemic heart disease, hypertension, asthma, etc.), and women menstruating or persons with open wounds are not allowed to use the Relaxation Zone.
  8. Children under the age of 15, the visually impaired, the physically impaired and individuals unable to move, undress and change their clothes without the help of others are only allowed to use the pool when accompanied by an adult. Parental or legal custody obligations are not transferable to other persons, in particular to the hotel staff.
  9. It is forbidden to bring into the Relaxation Zone any dangerous objects that could endanger the safety or health of others, in particular: glass containers, pressure containers (including deodorants, hairspray, etc.), knives and other sharp objects. These items must be left in the lockers.
  10. In all areas of the Relaxation Zone, one uses flip-flops to ensure both safety and hygiene.
  11. Sauna area is only allowed for persons over 15 years of age with the exceptions of the days of the obligatory clothes-free zone. On such days, the sauna area is only accessible for persons over the age of 18.
  12. Sauna area can be a cloth-free zone and on the days indicated by the hotel ( every Monday, Wednesday, Friday from 8 p.m.) it is strictly cloth-free. Sauna users are allowed to stay in the Sauna Area without swimsuits or other clothing and must take into account the possibility that other Guests may use the area not fully dressed or naked. In addition, Blue Diamond Active SPA Hotel reserves the right to specify other than the above-mentioned times for the clothing-free zone.
  13. Blue Diamond Active Spa Hotel provides one towel or pareo in the price of the ticket. Additional towels can be provided for an extra charge.
  14. Sauna can only be used by people in good health who have no medical restrictions to high temperatures. Sauna should not be used by, in particular:
  15. persons shortly after endurance training,
  16. people who want to reduce weight (e.g. before a competition),
  17. women during menstruation,
  18. people suffering from glaucoma,
  19. people suffering from epilepsy and psychotic conditions,
  20. people suffering from acute and chronic diseases, as well as carriers of such diseases,
  21. persons in a state of acute febrile illness,
  22. persons with a proneness to bleeding,
  23. persons suffering from chronic tuberculosis, cancer and anaemia,
  24. persons suffering from cardiovascular diseases,
  25. people suffering from reduced adrenal cortex function and hyperthyroidism and myxedema,
  26. people suffering from phlebitis, atherosclerosis and coronary artery disease,
  27. persons in post-heart failure and post-concussion states,
  28. people suffering from severe skin conditions including eczema,
  29. people suffering from acute inflammation of internal organs,
  30. people with symptoms of decompression,
  31. persons suffering from severe vegetative disorders of the central nervous system with serious circulatory disorders.
  32. Access to the sauna area is subject to prior confirmation of the lack of the above-mentioned contraindications and adherence to the above Rules and Regulations.
  33. Please enter the saunas barefoot.
  34. It is required to enter the steam (wet) saunas barefoot and without a towel. Before taking a seat on a bench in the steam (wet) saunas, please rinse with water using the hose located at the entrance. Please repeat this procedure at the end of your session.
  35. Only staff members are authorised to operate the sauna and the equipment in it. It is forbidden to use any liquids, essential oils or other substances that were brought with you for steam baths. Any objects (e.g. towels, bathrobes and sheets) must not be left in the immediate vicinity of the sauna heater.
  36. Please be aware of the temperature difference when staying in the separate sauna rooms - always be aware of the state of your health.
  37. Should you feel unwell, dizzy, short of breath, etc., it is imperative that you notify the sauna staff. If possible, leave the Sauna Area immediately.
  38. Do not touch the parts of the system supplying heat to the appliances as this may result in burns.
  39. It is not allowed to pour liquids on the sauna heater other than the ones specially prepared for this purpose by the Sauna supervisors.
  40. Please use pareo / towel in the dry saunas in accordance with the sauna rules provided in the Sauna area - please sit or lie down on the benches in such a way that no part of your body comes into direct contact with the boards (including your feet). Please use a pareo or towel for this purpose.
  41. Please comply to the rules of the sauna area when using it.
  42. Sun loungers and seating area can only be used after being covered (e.g. with a towel, coat or bath sheet).
  43. The conduct of guests in the Sauna Area must not disturb or cause a nuisance to other visitors. Running, shouting, obtrusive gazing at others, etc. is forbidden. Everyone using the premises intended for recreation and leisure is obliged to maintain peace and quiet. No sexual activities or conduct of a sexual character is permitted in the Sauna Area.
  44. Guests whose comfort or sense of security has been violated as a result of the conduct stated above, or for any other reasons, should report it to sauna staff immediately.
  45. Before entering the swimming pools, as well as before using the loungers, it is prohibited to use any kind of body lotions.
  46. Persons failing to comply with the above rules and regulations are subject to being reprimanded by the staff and/or be ejected from the Relaxation Zone without reimbursement of the entrance fee.
  47. It is forbidden to have cameras, phones, camcorders and other devices that may record images inside the Sauna area. Those who do not comply with the rule may be ejected from the Sauna Area by the staff without reimbursement of the entrance fee.
  48. Prior to entering the Spa, all users are required to read and follow the Spa rules and conditions which are available at the reception desk.


SPA RULES


  1. Blue Diamond Hotel's Active SPA is a zone of tranquility and relaxation for mind, body and soul. In order to ensure maximum comfort to our Guests, it is prohibited to use personal audio and video players, cameras and mobile phones. The SPA area is a designated quiet area. Staff of the Spa have the right, with no reimbursement of costs incurred, to eject anyone who in any way disturbs other Guests.
  2. Children over 2 years of age are allowed to use the SPA under supervision of adults due to the rendering of services for children (massages and other treatments ).
  3. SPA services at the Blue Diamond Hotel are available upon paying for the treatments according to the price list of the SPA.
  4. SPA is open from Monday to Friday from 12. pm to 10.00 pm, on Saturdays from 10.00 am to 10.00 pm, and on Sundays from 10.00 am to 6.00 pm. Blue Diamond Hotel reserves the right to change the opening hours of the Spa facilities.
  5. Spa Users should be aware that some services are of an intimate nature (such as massage) and should not be taken as surprise by this fact when using the Spa.
  6. Spa staff reserve the right to end a treatment should the staff be confronted with inappropriate behaviour of users (e.g. sexual proposals, aggression, etc.). In these circumstances, the total amount of the treatment will be charged.
  7. A User who decides to use Spa services is aware of the state of his/her health and is not withholding any information concerning a current medical condition. Any guest who does not disclose information about their medical condition, does so at their own risk. Guests suffering from any medical conditions are required to inform a therapist or a Spa receptionist at the time of booking a treatment or immediately before the treatment.
  8. The user has the right, after consultation with the therapist, to choose a treatment the therapist does not recommend, but does so at their own risk.
  9. Spa users who are allowed to use the Spa are:
  10. - persons who are over the age of 18,
  11. persons under the age of 18 who are accompanied by an adult ,
  12. persons with a medical condition, illness - provided that they inform the therapist of the situation and the therapist is certain that the client's health will not be affected by his/her actions. In such circumstances, it is up to the practitioner to decide whether the guest will be able to use the service.
  13. Pregnant woman - unless a written statement is provided indicating that she is aware of her condition and voluntarily decides to undergo the treatment requested. The therapist has the right to refuse a treatment if he/she considers it to be potentially hazardous to the woman's health.
  14. Users who are strictly prohibited from using Spa services:
  15. persons who are in a condition indicating the consumption of alcohol or other intoxicating substances,
  16. persons with open wounds and inflammation affecting the skin,
  17. persons whose conduct poses a danger to other guests or staff,
  18. persons whose hygiene is out of line with generally accepted standards,
  19. people who are ill and whose illness could threaten the health of practitioners.
  20. Guests who intend to undergo treatments with the equipment are obliged to read the contraindication list. Reading the contraindication sheet is confirmed by providing personal details and signing the form with one' s signature and the date it was filled in. Users who do not sign the contraindication form are liable to be refused treatment.
  21. You must arrive at the SPA at least 10 minutes before your scheduled treatment in order to complete the Consultation Form. Should you arrive late for your treatment, it will be deducted from your total duration of a treatment. Being more than 15 minutes late, without prior notice, spa staff reserves the right to cancel your appointment.
  22. A treatment booking that has not been paid for in advance can be cancelled. The cancellation of such a booking must be notified at least 4 hours before the scheduled treatment, in order to enable other Clients to use the services. In case of the hotel guests, the amount of 40 % of the total price of a treatment will be added to the bill if the treatment is not cancelled at least 4 hours before the planned treatment.
  23. Treatments paid in advance but never provided, due to the Guest's fault, are not subject to exchange for any other treatments. Please note that SPA will not refund such payments.
  24. Please change in the changing room and leave your personal belongings in the designated lockers before using the services. Guests are provided by the Spa with a necessary garment for the performing services.
  25. Treatments are carried out in Spa rooms adapted to a specific service provided.
  26. In order to guarantee safety to users, as well as to increase the effectiveness of treatments, it is necessary:
  27. to inform the practitioner of any medication taken, medical history, possible contraindications or previous use of similar services before the treatment,
  28. to use the swimming pool, jacuzzi and saunas prior to undergoing treatments,
  29. not eating large meals, at least one hour before the treatment,
  30. avoiding sunbathing immediately before and after the treatment,
  31. drink plenty of still water after the treatment.
  32. It is forbidden to bring dogs or other animals into the Spa area.
  33. In the event of loss, damage or soiling of the objects or equipment constituting the facility's property, Guests are obliged to compensate for the damage caused with the payment towards compensation. The amount of compensation is assessed each time, based on the estimated loss.
  34. Any complaints and grievances must be reported during or immediately after the treatment. Otherwise complaints will not be taken into account.
  35. We recommend that you book your treatment a few days in advance. We cannot guarantee that a treatment will be provided if no prior booking is made.
  36. When booking treatments exceeding PLN 200 by outside guests, the hotel reserves the right to charge a deposit of 50% of the value of the booked treatments, or 50 PLN when the treatment is not specified. The deposit needs to be settled in the form of a money transfer to the indicated account or pre-authorisation from the guest's credit card, at a time specified by the SPA Receptionist. The Hotel has the right to cancel bookings due to lack of deposit payment.
  37. It is possible to purchase vouchers, passes, one-time passes as a gift with a specified expiry date at the SPA Reception. Active SPA reserves the right not to renew an expired voucher, season pass, admission pass. Any other matters will be dealt with individually by the Spa Manager.
  38. Users who do not comply with the rules stated in the above Rules and Conditions can be reprimanded by the staff or ejected from the Spa.





LIABILITY


  1. Guests use the Relaxation Zone with its attractions, play equipment and sports equipment at their own risk. The owner is obliged to maintain the pool and its equipment in a condition ensuring the safety. Blue Diamond Hotel's Active SPA is not liable for personal injuries due to Force Majeure or solely due to the fault of the injured party or a third party for which the The Hotel is not liable for any loss, damage to any belongings being brought to the premises.
  2. The guest is liable for any damage caused by inappropriate use of the pool facility and equipment on the premises or caused by inappropriate behaviour when using the pool. Parents and legal guardians are fully responsible for their children and any damage caused by them.
  3. Any accidents, incidents or damages must be reported immediately to the facility staff. The hotel is not responsible for any aggravation of damage resulting from a delay in reporting it.
  4. In matters not regulated by these Rules and Regulations, the Laws of the Civil Code, the Law of 18 August 2011 on the Safety in Water Areas shall apply.
